Legal Notice for ASPIDA LTDA Mobile Application
1- DISCLAIMER: This product has been designed for the exclusive use as a complementary tool for remote alarm monitoring systems provided by ASPIDA LTDA.
This implies that if you have not previously contracted the monitoring service from our company and have not been specifically instructed to download this application on your cell phone, the application you are about to acquire WILL NOT HAVE ANY USE. This means that it will not accomplish its objective, which is to provide the tools required for producing an early alert when facing specific events (preconfigured as such); these alerts are always directed to our central monitoring station.
The above declaration is of essential importance considering this application is a tool which links its user directly with the monitoring and response center of ASPIDA LTDA. If you are not an active client of our monitoring service, the event will not be received nor answered by anyone, making the event impossible to handle. Hence, the user of this application will not be assisted when an event is sent if they do not have a valid and active service contract.
This App is meant to be downloaded only once and perpetually. Whoever downloads the App, will do so directly from the application store corresponding to the operating system of the smartphone. Once downloaded, lifetime access to improvement and update downloads will be granted free of charge.
2- LIMITATION OF LIABILITY: The developer and titleholder of this application, ASPIDA LTDA, limits its responsibility EXCLUSIVELY to the proper technical operation of the application. The company is not directly nor indirectly responsible for the operation of the connections used by the smartphone (Internet, mobile networks, telephone systems, Wi-Fi, etc.), which depend on third-party connectivity providers.
In the same way, ASPIDA LTDA will not be held responsible for any actions or omissions attributable to public security forces (Police, Fire Department, Civil Defense, etc.) or private emergency services which may be activated as a consequence of an event alert sent from the application.
3- COMPATIBILITY AND REQUIREMENTS: For the present application to connect with our remote alarm monitoring center, it is an mandatory and indispensable requirement that the buyer must be an active client with an ongoing contract with ASPIDA LTDA. If you do not meet this condition, DO NOT ACQUIRE OR DOWNLOAD THIS APPLICATION, since it WILL NOT WORK nor accomplish its objective.
4- ACCESS TO YOUR LOCATION AND ADDITIONAL PERMISSIONS: This security app requires access to your location continuously, including background tracking (always active), provided that the user accepts the corresponding access permissions on the device. This function is of vital importance since, when sending an emergency event, the user's exact location will be sent in real-time so that our monitoring center can locate you and coordinate the corresponding assistance. When sending an event, the user can view the location sent to the control center.
Additionally, for its proper operation and for evidence transmission during an emergency, the application requires other critical permissions (such as access to the camera, audio recording, or backup SMS sending, as applicable). Refusing these permissions may drastically limit the effectiveness and functions of the application in high-risk situations.
5- GOVERNING LAW AND JURISDICTION: This legal notice and the use of the application are governed by the laws of the Republic of Colombia. Any dispute arising from this document shall be submitted to the competent authorities and courts of Colombia.
